LAWN MOWING & GARDEN SERVICES – WORKMANSHIP WARRANTY POLICY

1. Introduction

This Workmanship Warranty (“Warranty”) is provided by Aussie’s Garden Servcies (“the Business”, “we”, “us”, “our”, “AGS”) for lawn mowing and garden services delivered to residential and commercial customers (“the Customer”).

This Warranty outlines the extent of protection offered for workmanship-related issues and sets the terms and conditions under which warranty claims may be made.

2. Warranty Coverage

We guarantee the quality of our workmanship on the following services:

  • Lawn mowing & edging
  • Hedge trimming
  • Shrub pruning
  • Garden clean-ups
  • Weed removal (non-chemical)
  • General garden maintenance
  • Blowing and removal of grass/debris created by our service

If the Customer identifies a genuine workmanship issue, we will return and rectify the issue at no additional cost.

3. Warranty Period

  • Lawn Mowing Workmanship Warranty: 48 hours from the completion of service
  • Garden Services Workmanship Warranty: 72 hours from completion of service
  • Service Plan Members (Weekly/Fortnightly): 7-day extended workmanship warranty

Claims submitted outside these timeframes will not be covered.

4. What the Warranty Covers

This Warranty ONLY covers mistakes or omissions in the work performed by us, including:

  • Missed patches of lawn
  • Uneven mowing caused by operator error (not natural uneven landscape)
  • Missed edges
  • Debris not blown/cleared
  • Uneven shaping of hedges or shrubs
  • Incomplete work compared to the agreed service description

5. What the Warranty Does NOT Cover

To protect fair use and ensure business viability, the Warranty does not cover:

Natural Growth & Environmental Factors

  • Regrowth of lawn, weeds, or hedges after service
  • Weather impacts (rain, heatwaves, drought stress, frost damage)
  • Leaf fall, debris, or branches occurring after completion of service

Customer or Third-Party Factors

  • Work compromised by pets, wildlife, or visitors
  • Issues caused by property owners altering the lawn or garden
  • Unreasonable service delays requested by the Customer
  • Access restrictions preventing completion

Agronomic, Biological & Seasonal Factors

  • Weed re-emergence after non-chemical removal
  • Lawn deterioration due to poor soil, pests, disease, over-watering or underwatering
  • Damage from vehicles, rubbish bins, foot traffic, or construction

Scope Exclusions

This Warranty does not apply to:

  • Chemical weed treatments
  • Fertilising results
  • “End of lease” disputes not relating to workmanship
  • Services performed outside the agreed scope

6. Customer Responsibilities

To maintain validity, the Customer must:

  1. Report issues within the warranty period

  2. Provide clear description or photos when requested

  3. Allow reasonable access for inspection and rectification

  4. Not attempt DIY repair before assessment

7. Remedy

If a claim is approved, AGS will:

  • Return and rectify the workmanship issue
  • Complete only the portion of work originally included in the contracted service
  • Provide no financial compensation unless legally required

8. Limitation of Liability

To the maximum extent permitted by law:

  • Our liability is limited strictly to the cost of rectifying the workmanship issue
  • We are not responsible for indirect or consequential loss
  • No refunds are provided for services where the issue relates to natural growth or conditions outside our control

9. Governing Law

This Warranty is governed by the laws of:

  • The Australian Capital Territory (ACT)
  • New South Wales (NSW)
